Book Strawberry Cottage

  • Terms and Conditions of Let
    Your reservation is a legal contract, and Strawberry Cottage should only be used by
    individuals or groups to provide accommodation in Glen Affric while they pursue their
    sporting activities/ interests/hobbies and for no other purposes. The cottage should
    not be used as a holiday home or for stag parties, hen parties, weddings or any
    special event without prior discussion and written agreement.
    1. Definition of Terms
    Strawberry Cottage is leased by An Teallach Mountaineering Club from National
    Trust Scotland. Parties applying to stay at Strawberry Cottage are referred to as 'the
    Clients' until the commencement of their let when they are referred to as 'the
    Tenants'. An Teallach Mountaineering Club are referred to as 'the Owners', and
    these terms set out the terms of the contract between the Clients/Tenants and the
    Owners.
    2. Payment
    When booking online the full rent must be paid at the time that the booking is made.
    If the Owner is unable to accept a booking, then all monies paid will be refunded as
    soon as it can be arranged. When an online booking is not available and a booking
    is arranged by email or by phone then payment is to be made once booking and fee
    has been agreed. Bookings will not be binding until payment is received.
    3. Authority to Sign
    The person completing the booking form certifies that:
    a. He/she is authorised to agree the booking conditions on behalf of all persons
    included on the booking form, including those who may be added/substituted later.
    b. He/she is over 18 years of age and is a member of the party intending to occupy
    the property.
    c. He/she agrees to take responsibility for the party occupying the property.
    4. The Tenancy Agreement
    The tenancy gives the Tenants the right to occupy the property for the duration of the
    booking within the meaning of Schedule 4 paragraph 8 of the Housing (Scotland) Act
    1988. Lettings commence at midday (unless otherwise stated) on the first day of the
    tenancy and end at midday on the departure date unless otherwise agreed. The
    tenancy period cannot be extended without the Agent's permission.
    5.Overstaying
    If the Tenant overstays for any reason and does not vacate by midday on the
    departure date then the Owner may charge the Tenant a minimum charge of £50 up
    to the cost of a full days rental, together with any ongoing costs, losses or expenses
    arising directly or indirectly as the case may be from the failure to vacate, including
    without limitation the loss of any booking of the property due to commence at the end
    of the Tenant’s letting of the property.
    6. Linen
    Tenants should bring their own sleeping bags and towels. Tea towels are provided.

    7. Fuel/Utilities
    The rental cost includes the use of firewood for the wood burning stoves and LPG for
    cooking. Lighting is provided via solar power with a petrol generator backup. Water
    is available during the summer period (May-October). Outside of these times guests
    will need to collect water from the river using buckets and storage barrels are
    provided at the cottage. All water must be boiled before consumption. Guests are
    advised to bring drinking water in with them.
    8. The Tenants' Obligations
    a. To report to the Owners any losses or damage to the property caused by the
    Tenants or a member of their party (reasonable wear and tear excluded).
    b. To take good care of the property and leave it in a clean and tidy condition at the
    end of the tenancy. No cleaning service is provided so please leave the cottage as
    you would like to find it.
    c. To allow the Owners and Agent reasonable access to the property.
    d. To not exceed the total number of people as stipulated in the description of the
    property, and not to transfer possession of the property or share it except with
    members of the party stated in the booking. Maximum of 2 cars parked at Cottage.
    e. To use the property for accommodation and not to be a nuisance to occupants of
    any adjoining/neighbouring premises or others using Glen Affric. No camping
    outside the cottage and strictly no fires/barbeques.
    f. Not to smoke in the property.
    The Owners reserve the right to charge Tenants for additional cleaning that may be
    required if any of the above Obligations are breached.
    9. Alteration/Cancellations of a Booking
    Once a client has made a booking, no refund will be given unless the client gives
    sufficient notice (a minimum of 4 weeks) before their planned visit and the period of
    their booking is utilised by an alternative group. If there are extenuating
    circumstances, exceptions may be considered.
    28 days or less notice - No refund is due (100% if alternative client utilising period )
    > 28 days’ notice - 33% rental returned (100% if alternative client utilising period )
    10. Complaints
    We will endeavour to ensure that your stay at Strawberry is without issues however
    the property’s appeal in being 6 miles from the highway and no phone reception
    does make it challenging for us to respond to issues. If you do find any issues that
    spoiled your stay or feel that the previous tenants have not left the cottage as you
    would expect to find it, please get in touch with us as soon as is convenient.
    11. Non-availability of Property
    If for any reason beyond the Owner's control the property is unavailable on the day
    when the tenancy is due to begin or the property becomes unsuitable for letting,
    clients will receive a full refund of all rents and charges already paid. The Owner will
    not be liable for any other costs incurred by the client/tenant.
    12. Liability
    The Owner accepts no liability for any act, neglect or default on the part of any other

    person not employed by them or under their control, nor for any accident, damage,
    loss, injury, expense or inconvenience to either person or property which the
    Tenants, or any other person, may suffer or incur arising from, or in any way
    connected with, the Tenancy. The Owners accept no liability for loss or damage to
    the Tenants' possessions on the Owners' land or property unless caused by the
    Owners negligence. Please also refer to section 16.
    13. Breach of Contract
    If Tenants breach any of the above terms and conditions the Owners reserve the
    right to re-enter the property and terminate the tenancy, without prejudice to the
    other rights and remedies of the owners.
    14. Validity Clause
    If any term or provision in these Booking Conditions shall in whole or in part be held
    to any extent to be illegal or unenforceable under any enactment or rule of law, that
    term or provisions or part shall, to that extent, be deemed not to form part of this
    agreement and the enforceability of the remainder of this agreement shall not be
    affected.
    15. Force Majeure
    The owner accepts no liability and will not pay compensation for any loss, damage or
    expense where our obligations are prevented or affected by reason of force majeure.
    Force Majeure means any event which we or the owner providing the service could
    not, even with all due care, foresee or avoid such as war or threat of war, riots, civil
    strife, terrorist activity, epidemic, pandemic, industrial action, natural or nuclear
    disaster, fire, adverse weather conditions, closure of airports or ports, technical
    problems with transport, governmental action and all other similar events.

    16. Governing Law and Jurisdiction
    The contract is deemed to have been made at Strawberry Cottage, Athnamulloch,
    Beauly. The validity, construction and performance of this Agreement shall be
    governed by Scots' Law. The Clients and the Tenants submit to the exclusive
    jurisdiction of the Scottish courts.
